Sal
Herman never has to adjust his belt -- not even after a big
holiday meal. Why?Because Herman, who is 66 and
lives in Bloomfield Hills, and wears suspenders not
restrictive belts. He wears them every day and has done so
for years because, as his wife and business partner, Judee
Herman, points out, his body is shaped like a carrot --
broad on top and quite tapered toward the bottom. Which
means he doesn't have the hips or rear end to keep up his
belt. And once his belt goes, so do his pants.
Additionally, Sal Herman says he feels taller in suspenders.
"A belt kind of cuts you off," he said.
"When you take the belt off, you immediately look taller.
Clothes fit better and they hang just right."
Also, he believes suspenders are beneficial to his health. A
belt will squash a wearer's internal organs, he said, adding
that he has no significant medical training. "It's not
rocket science. Everybody knows that!" So intense is Herman's devotion to suspenders -- and the 1%
of the population he says wears suspenders -- that he has
turned them into an unlikely and thriving business. About
2,400 stores nationwide sell his Holdup brand suspenders.
And he's expecting a record-breaking 2012 season on his
company's website.
The holiday season, it turns out, is also suspender gifting
season. Among the current hot sellers from Herman's
Southfield-based Hold-Up Suspender Co are Red suspenders.
"I don't know if it's a red thing for the holiday or if
people have a Santa Claus costume and they need red
suspenders," said Herman, who is known by some as the
Suspender King. "They just buy them to hold their pants up."
How they got started .. Herman's rise as suspender
supplier to men in Santa suits was a long time coming for
the Israeli immigrant. He was trying to make ends meet,
working as a auto model and pattern maker for an automotive
parts company in 1973, when he decided he had to do
something about the cheaply made clip-on suspenders he wore
on the job.
"Every time I would bend over, the clip in the back --
that's where it pulls, always one of the back clips -- would
slip off and hit me in the back of the head," Herman
said. So he set up a makeshift shop in the garage -- or
maybe it was on the kitchen table, neither Sal nor Judee
Herman can recall.
"We didn't have any tools," said Judee Herman, who
like husband Sal is 66. "We didn't have two nickels to
rub together. ... He bought one of these big magnifying
glasses that you clamp onto a table." And within a couple
weeks, Sal Herman had solved his suspender clip popping off
problem.
He'd invented a new suspender clip, one with a pin in its
middle that pierces the fabric, making it virtually
impossible for it to slip off his pants -- even when he's
got pockets filled with a phone, coins, tools and a wallet.
He even has a new Patent for the composite plastic Gripper
Clasp that hold tighter... the harder you pull on them.
Herman was thrilled with his clip invention and he made some
home made suspenders for his brothers-in-law, who were
enthusiastic as well. And while they all walked around with
their heads held high, just like their pants, that was as
far as Sal Herman's no-slip suspender clip went -- until
1988.
After being laid off from automotive work, he pursued a new
career; he and his wife had built a successful business
performing hearing tests for employees at factories....
www.HearingTestLabs.com
"With a lot of gumption and work, you can make it in this
country," Sal Herman said. "I could not afford college.
People, they don't have that money, especially today,
college is 10 times more than 50 years ago. It doesn't mean
you give up and die and roll over."
Finally having money to invest, the couple decided to take a
gamble. They paid for a patent search to see whether anyone
had made a similar suspender clip. When that search turned
up nothing, they applied for a patent. Two years later,
they received one -- the first suspender clip patent in more
than 100 years.
"We can't really believe ... that we were able to get a
patent on suspenders," said Judee Herman. "They've
been around for a long time."
The Hermans' plan to sell the patent proved difficult. "Nobody
felt there was a need for this product, for a clip that
doesn't slip," said Sal Herman. "People, I don't know
if they never
complained to store owners about their suspenders slipping.
I contacted the manufacturers that made suspenders," he
said. "It was a good product. I knew it worked so well.
Those people I tried to approach to sell it, maybe they
didn't understand there was a market for this product."
Ideas keep coming to the rescue in Detroit and by 1996, the
Hermans' Holdup Suspender Company was up and running and
selling suspenders, mostly through advertisements. They
opened an Internet store in 1997 at
www.mysuspenders.com
and by 1998, they had moved into the suspender wholesale
business. The company, which Sal Herman expects to bring in
about $2 million this year, stocks suspenders in more than
250 styles and colors, though basic black, brown and blue
are the most popular.
"The people who wear his suspenders aren't wearing them
to be fashionable", he said. Although he has designer
patterns, stripes, silks and even leather braided styles to
choose from...
"Listen Sister, I sell a pair a day," said Mindy
Gustin, a sales associate at Stallone's, a men's store in
Anchorage, Alaska, which, according to Herman's records,
sells more suspenders than most of the hardware, sporting
goods and clothing stores that stock them."I think a lot of
it has to do with our utilitarian perspective, living in
Alaska," Gustin said. "We are not a fashion forward kind
of state. Most of our guys wear flannels and jeans."
Herman's ideas keep coming.... He has developed
suspenders for skiers to wear over their ski pants,
suspender boot straps to keep motorcycle riders' pant legs
from creeping up in the wind, suspenders designed to be worn
under clothing next to the skin called Under-Ups. ("There
are a lot of men you wouldn't know are wearing suspenders
because they're wearing our hidden undergarment suspenders,"
said Judee Herman.) We even make USA made Maternity
suspenders. And suspender-friendly jeans -- jeans that don't
have belt loops -- although those are being phased out
because of sizing issues.
Now, if history holds true, sales at the Hold-Up website,
www.mysuspenders.com, will be busy this weekend. From Black
Friday to Cyber Monday last year, the website averaged more
than 300 sales a day -- up from an average of about 40-50 a
day. All because Sal Herman couldn't keep up his
pants.

After the men's
accessories Sal Herman makes
were discovered marked with
expired patent numbers, Holdup
Suspender was sued in September
and threatened with a maximum
$500 fine per pair, potentially
costing him millions of dollars.
The case was
dismissed in the U.S. District
Court in March in Detroit after
the plaintiff, Akron-based
Unique Product Solutions, saw a
similar case dismissed in
federal court in Cleveland. The
judge there concluded that the
False Marking Statute was
unconstitutional, because it
gives criminal law-enforcement
power to private entities
without any U.S. Department of
Justice control.
According to
recent interpretations of patent
law, people who find an item
emblazoned with an out-of-date
patent number can sue -- even if
they're not directly involved,
like a competitor -- and be
awarded 50% of the fine
collected, which is as much as
$500 for each incorrectly marked
item.
"They're
trying to get money they don't
deserve," Herman's lawyer John
Artz said. "Sal Herman had no
intent to deceive. UPS didn't
really prove (it). They just
wanted to get a fast settlement
to get some money, but Sal was
not going to cave in to this
shakedown, as he called it."
Attorneys for
Unique Product Solutions could
not be reached for comment.
Herman said
the whole saga cost him $50,000
in legal fees, plus $30,000 to
grind the old patent number off
each suspender clip.
"I was not
victorious in a sense, because
it cost me $80,000," said
Herman, who has four employees
in his 6,000-square-foot
warehouse-office space. "My wife
calls it extortion and I just
call it injustice. It just
wasn't right, not the American
way of legal action."
Patent number
4,901,408 -- for a suspender
clip that includes a small pin
to better grasp the pants fabric
-- expired in June 2008, 20
years after he applied for it.
In 2010, he got a new patent for
an updated pin suspender clip,
number D614946 and other patents
on his new Gripper Clasp
(plastic suspender buckle).
The
up-to-$500-per-item windfall was
enough to inspire a flood of
lawsuits.
"Lots of
people started bringing these
actions. It's caused a lot of
concern, because people were
concerned about their exposure,"
explained Jake Grove, a patent
attorney in Honigman Miller's
Bloomfield Hills office. "From a
policy standpoint, do we want
all of these lawsuits? There
were at least 950 similar false
patent marking cases filed in
federal district courts since
Jan 2010."
The HoldUp Suspender Company has
revolutionized the world of men's suspenders.Husband
and wife team, Sal and Judee Herman, started the company after they realized that people
were frustrated with clip-on suspenders that kept slipping off their pants. The
company introduced its first product, theNo-Slipä suspender clip
line in 1996 after receiving a US Patent. In
2002, the company launched its dual clip Double-Upä suspenders,
which have the classic look of button-on braces, yet the ease of using the no-slip
clip" to quickly attach pants without sewing on suspender buttons. Then, in 2004, HoldUp added Sloopsä, a line of
loopless blue jeans designed specifically for the suspender wearer. All Holdup products carry a life time clip warranty and
30 day "no questions asked" money back satisfaction guarantee. HoldUp
Suspender Company is a Michigan-based company with products available at over 2300 stores
nation-wide and online at www.mysuspenders.com, or via mail order (a full color catalog can
be ordered by calling (800)-700-4515).
New striped Holdups now in stock in both single and
dual clip Double-Up styles.
In 2012 Holdup's founder, inspired
by suspenders seen in movies,
introduced Wall Street Gordon Gekko style
striped jacquard suspenders.

We made a better mousetrap. . .now
were in about 2,000 stores.
Sal Herman co-founder, Hold-Up Suspenders
Herman, along with his wife, Judee, started the
Southfield-based Hold-Up Suspender Company with a simple concept: They added a tiny needle
to the inside of the traditional suspender clip, which pierces the fabric to keep the
suspenders in place. We made a better mousetrap, said Herman. Weve
been making them ever since and now were in about 2,000 stores.
Business has been growing very slowly, because of the small
market niche that Herman has to work with. I just happen to be a person who wears
suspenders every day. I need them to keep my pants up. But its not a fashion
statement today. It was maybe 20 years ago. Its possible it will be again. Hollywood
has a lot to do with it. They became very popular after the movie Wall Street.
Herman attended his first trade show in Pennsylvania in 1990. It took him six more years
to patent his product and find a manufacturer in the U.S. to produce them.
Everything is made overseas but it was really important to us to have our product
made in the U.S. It took us a long time to find someone who would make it to our exacting
specifications, said Judee Herman. Our goal is to make every man a suspender-
wearer. Countless hours of phone calls, networking and
research went into the business in the beginning. So many, in fact, that Herman said only
a self-employed businessman could make it work. The Internet sure adds to our reach.
If I worked a regular 9-to- 5 job, I would never have
been able to do it. It took a few years, but now its profitable. To avoid the
heavy marketing costs, they have taken a grass-roots approach to reach their
small market, said Herman. Their marketing efforts include selling Hold-Ups through
catalogs and the Internet and advertising in magazines geared toward seniors, like
American Legion and the Elks Club. Their newest product is a dress suspender called
Double-Ups, and is marketed to a younger, professional crowd. The Hermans want their
suspenders to not only be utilitarian but also fashionable. Smart fashion
with the snap of a clip, is the new products slogan, said Judee, who
serves as advertising director and marketing advisor.
The West Bloomfield couple has always worked together, and
Judee said she calls her husband, My Suspender King.
Sals advice for an entrepreneur who thinks they have a good invention?
Dont give up. If they have a feeling for it, and if theres enough time,
theyll make it.
